Terms of Service
1. Who we are
Qhike is a web studio based in Fredericton, New Brunswick, Canada. You can reach us at info@qhike.ca or +1 506-801-9970.
2. What we do
We build websites and set up and manage Google Business Profiles for local businesses. The exact work is set out in the quote we send you before we start. Anything not listed in that quote is not included.
3. Prices and payment
All prices are in Canadian dollars and exclude HST. Build work is quoted as a one-time price and is payable before the work goes live unless we agree otherwise in writing. Monthly plans are billed in advance by pre-authorised debit or card. Annual plans are paid in full at the start of the term.
4. Your domain
Your domain name is registered in your name, using your own payment card, and remains your property at all times. It renews directly with the registrar, usually around $20 per year. We do not pay for, own, or control your domain. If you stop working with us, your domain is unaffected and you keep it.
5. Hosting on a one-time build
If you buy a website without a monthly plan, we set the site up on a hosting account created in your name and under your email, connect your domain, and hand you the login. The site is yours to run. Standard hosting for a site of this size is normally free. Once we hand over, we are no longer responsible for the site, and any later work is quoted separately or covered by starting a monthly plan.
6. Hosting on a monthly plan
If you have a monthly plan, we host the site on our account and look after it for you. Hosting, SSL, backups, security updates and uptime monitoring are all included for as long as your plan is active.
7. What monthly plans include
Monthly plans cover hosting, security updates, backups, uptime monitoring, fixing things that break, and the content changes described in your plan. Content changes mean edits to existing text, photos, prices and hours. New pages, redesigns, new features, and new functionality are separate work and are quoted before we start. Unused editing time does not carry over to the next month.
8. Google Business Profile
Your Google Business Profile belongs to you and always has. Where we set one up on your behalf, ownership is in your name and we are added only as a manager. If you leave, we remove ourselves as a manager and you keep full control. Google decides how listings appear and may change its rules, remove content, or suspend listings at its own discretion.
9. Turnaround
We reply to messages within one business day. Website builds typically go live about two weeks after we start, once we have your content and approvals. Delays in receiving content or approvals will move that date.
10. Revisions
Website builds include two rounds of revisions before launch. Further changes after that are quoted separately, or covered by your monthly plan if you have one.
11. Cancelling
Monthly plans can be cancelled at any time with 30 days written notice. Annual plans run to the end of the paid term and are not refunded, though you keep the service for the full term. One-time build work is not refundable once the work has started.
12. When a monthly plan ends
When a monthly plan ends, hosting and care end with it. We keep your site online for 14 days after your final billing date so you have time to move it. Within that window we will give you a copy of your website files and the settings you need to point your domain at your new host. After 14 days the site is removed from our hosting. Your domain, your files and your content remain yours throughout.
13. Late or failed payments
Monthly payments are collected automatically. If a payment fails, we will let you know and try again. If an account stays unpaid for 30 days, we may pause work and, after written notice, suspend hosting until it is settled.
14. Your responsibilities
You are responsible for the accuracy of the information you give us, including hours, prices, services and photos, and for having the right to use any photos, logos or text you send us. You are also responsible for keeping your domain registration and payment card current.
15. Price changes
We may increase monthly prices by up to 5% per year, with at least 60 days notice in writing. Your build price never changes after it is quoted.
16. Third-party services
Some parts of what we provide rely on services we do not control, including Google, your domain registrar, hosting providers and payment processors. We are not responsible for outages, policy changes or decisions made by those services.
17. Confidentiality
We keep anything you share with us about your business private, and we only use it to do the work you have hired us for. We may show your finished website and describe the work publicly as an example of what we do. If you would rather we did not, just tell us and we will not.
18. Limits
We do our best work, but we cannot guarantee specific search rankings, traffic, phone calls, or revenue. Our liability is limited to the amount you have paid us in the previous three months.
19. Ending work early
Either of us can end the working relationship with 30 days written notice. If we end it, we will refund any prepaid time you have not used, help you move your site, and hand over your files.
20. Changes to these terms
We may update these terms from time to time. If we make a significant change that affects existing clients, we will let you know by email at least 30 days before it takes effect.
21. Governing law
These terms are governed by the laws of the Province of New Brunswick and the laws of Canada that apply there.
